DUI : Driving Under the Influence of Drugs or Alcohol
There are two major hurdles you have to face as a consequence of your DUI arrest in California:
- DMV Hearing:
You must request, then attend, a DMV Hearing. A Stay and a Hearing buy you more time to drive and a chance at avoiding a license suspension.
- Court Case:
You must go to court to face criminal charges for DUI or drunk driving.
These two are separate events, in separate institutions. The court and DMV have separate and independent powers to suspend your driver's license.
To prepare for your DMV Hearing and your Court case after DUI arrest in California, you must take four essential steps :
- Request DMV Hearing within 10 days of your DUI arrest
- Obtain and review a copy of your Police Report
- Educate yourself about your DUI Defense options
- Know your options in Court - Plea Bargain or Trial
Call the DMV immediately after your Drunk Driving or DUI arrest to obtain a Stay and a Hearing- otherwise your license is subject to automatic suspension 30 days after your DUI arrest date.
You have only 10 days to call the California DMV after your DUI arrest date to obtain a STAY and a HEARING.
